Types of Sumner County Court Records

Public Access for Sumner County Court Records
Public access to Sumner County court records comes from several rules and channels. For county-agency records, Sumner County's KORA process goes through Debra A. Norris, County Clerk and Freedom of Information Officer. The county must act within three business days after receiving a request by providing records, explaining when and how records will be provided, or stating why the request cannot be granted. For court case records, the better first contact is the Clerk of the District Court because KORA does not turn the County Clerk into the court file custodian.
Note: KORA requires access to existing public records, but it does not require Sumner County to create a new report or interpret records.
Restricted Sumner County Court Records
Not every Sumner County court record is public online or public at the counter. Juvenile court, juvenile law-enforcement, and municipal juvenile records are restricted under K.S.A. 38-2309 and K.S.A. 38-2310. Adoption records, sealed cases, expunged criminal records, mental health and care-and-treatment materials, medical treatment records, Social Security numbers, account numbers, and attorney-client or evidence-rule material may be closed or redacted.
Expungement and sealing are not the same as deletion from every system at the same instant. A person usually must identify the case, confirm eligibility and waiting periods, file the correct petition or motion in the court that handled the matter, and wait for a judge's order. If access is restricted, CaseSearch and public courthouse terminals should not display the ordinary public view of the sealed material.
Sumner County Court Record Requests
